BaristaLabs, LLC provides AI-powered development solutions, including but not limited to:

• Process automation solutions
• AI consulting and strategic implementation
• System integration services
• API access and documentation
• Training and support services

3. User Accounts

To access certain features of our services, you may be required to create an account. You are responsible for:

• Notifying us immediately of any unauthorized use

We strive to maintain high service availability but do not guarantee uninterrupted access. We may temporarily suspend services for maintenance, updates, or other operational reasons.

To the maximum extent permitted by law, BaristaLabs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

10. Indemnification

You agree to indemnify and hold harmless BaristaLabs, LLC from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

11. Termination

Either party may terminate these Terms at any time. Upon termination, your right to use our services ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Leesburg, Virginia.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of our services constitutes acceptance of the modified Terms.

15. SMS Messaging Program

• Program name: BaristaLabs Assistant Texts
• Program description: BaristaLabs, LLC sends texts through our AI assistant to follow up on calls, confirm appointments, and schedule appointments. We don't send marketing messages.
• How you opt in: On a phone call, our AI assistant asks for permission out loud before any text is sent, and we text only after a clear yes. If you text a BaristaLabs number first, you consent to replies about that conversation only. We don't offer opt-in through a web form.
• Consent to receive text messages is not a condition of purchase.
• Message frequency varies.
• Msg & data rates may apply.
• Text HELP or INFO for help, or email sean@baristalabs.io.
• Text STOP to cancel/opt out at any time. You can also text STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. We'll send one text confirming you've opted out, and then no further messages. Text START to re-subscribe.
• Carriers are not liable for delayed or undelivered messages.

We do not share, sell, rent, or provide your mobile phone number, mobile information, or SMS opt-in data and consent to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy and SMS Consent & Messaging Policy for details.
